The 2025 decision by the Administrative Review Tribunal (ART) to agree with the Australian Human Rights Commision (AHRC) and disallow LAG’s application for SDA exemption has been disallowed by Justice Moshinsky in the Federal Court of Australia on 15 April 2026.
This judgment is historic because it recognises that the rights of women are sex-based and are not surpassed by the rights of men who identify as a woman. Furthermore, it judges as incorrect the AHRC guidelines for granting SDA exemptions that do not recognise women’s equal rights to other groups (such as men who identify as women).
We’re not there yet … but LAG and others are one step closer to being able to hold women-only events.
We now wait to find out how the judgment for the Giggle v Tickle appeal in the High Court will go for lesbian and all women’s rights.
